This page is waiting for a final legal review and may be updated.
These terms apply to swimming instructors who create a Swimvity account. Swimvity is operated by Markyn Media Pty Ltd, referred to here as “we” or “us”. Our details are at the end of these terms.
The service
Swimvity is software for running an independent swimming lesson business: a booking page where parents and carers send lesson requests, families and children's lesson details, recurring and one-off lessons, a calendar, travel-aware scheduling suggestions, a waitlist, attendance and records of lesson payments.
Scheduling suggestions are based on the information you enter, your teaching hours and, if you connect it, your Google Calendar. Travel times are estimates. A parent's booking request is only a request: a lesson is booked when you approve it.
You run your own lessons. You're responsible for your agreements with families, your prices, pool access, insurance, qualifications and any working-with-children requirements.
Your account and your data
- Keep your password and sign-in details secure, and tell us if you think someone else has used your account.
- Your business data belongs to you. You can download it at any time from Settings → Account & security.
- You confirm you're allowed to store the information families give you, including children's details, and that you'll use it only to run your swimming lessons.
- We handle personal information as described in our privacy policy.
Optional connections
You can choose to connect Google Calendar. Google's own terms apply to your Google account. You can disconnect at any time in Settings.
Emails
Swimvity sends account emails (such as sign-in and password emails). Depending on your settings, it can also email you about new requests and email families about their requests and lessons on your behalf. Swimvity doesn't send marketing to parents.
The subscription
Swimvity is currently available by invitation through the Founding 10 programme. A founding invitation gives you free access for at least 90 days from the day you sign up. The exact end date is shown in Settings → Billing.
Billing is currently switched off. No card is required, nothing is charged automatically, and your account keeps full access while billing is off.
Plans and pricing haven't been announced yet. Before any paid subscription is available to you, we'll tell you in advance and show its price clearly. A subscription only starts if you explicitly accept it and confirm it on our payment provider's secure page. Founding instructors will receive an exclusive offer when paid plans are introduced; its details will be shared in advance.
When billing is switched on, accounts that already exist get a free trial counted from that day, and any free access you still have continues to its end date. If a subscription is then required for your account and you haven't subscribed once your founding access and any free trial have both ended, your account becomes read-only: nothing is deleted, you can still see and download your data (including invoices and payment records), and changes and your booking page pause until you subscribe.
Families pay you directly. Swimvity doesn't collect lesson fees and charges no commission on them. Its payment records and invoices are tools for your own bookkeeping; you're responsible for their accuracy and for your own tax obligations.
Acceptable use
Don't misuse Swimvity, try to access other businesses' information, send spam through it, or use it unlawfully.
Availability and changes
We work to keep Swimvity available and your data safe, but we can't promise uninterrupted service. We may improve or change features, and we'll tell you in advance about changes that significantly affect you.
Your rights under Australian law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that can't lawfully be excluded, including in relation to refunds.
Closing your account
You can close your account at any time in Settings → Account & security. It becomes read-only straight away. The Swimvity team then completes the closure by hand and deletes your data no earlier than 30 days later, apart from records the law requires us to keep (such as financial records). If your account has invoices or payment records, we contact you before deleting anything. Download your data first. We may suspend an account that breaches these terms, after notice where reasonable.
